Terms and Conditions

These Terms and Conditions (“Terms”) apply to all services offered by Boatox (“we”, “our”, “us”) and govern the relationship between Boatox and the customer (“you”, “your”). By confirming a booking with us (via email, WhatsApp, or online), you agree to these Terms.

1. Scope of Services

  • Boatox acts as a concierge and booking partner. We connect customers with third-party providers such as yacht charter companies, drivers, restaurants, clubs, and villa owners.

  • Boatox is not a licensed yacht broker and does not operate vessels directly.

  • Your contract for the actual service (yacht, club table, villa, etc.) is always with the relevant third-party provider.

  • We make bookings in good faith but cannot guarantee availability, quality, or performance of any third-party services.

2. Bookings & Payments

  • A booking is confirmed once you receive a written confirmation from us by email or WhatsApp.

  • Full payment is required before access to any boat, villa, or service.

  • Payments must be made in EUR (€) via online bank transfer or credit card. Cash and PayPal are not accepted.

  • Any bank fees, credit card fees, or currency conversion costs are the responsibility of the customer.

  • Chargebacks: Any fees arising from chargebacks will be passed on to the customer.

3. Cancellations & Refunds

Our cancellation and refund policy is published separately here and forms part of these Terms. Please review it carefully.

4. Liability & Insurance

  • All yachts are insured by their respective owners/operators. Coverage details vary by vessel.

  • Boatox itself does not provide insurance.

  • Customers are fully responsible for any damages, losses, or costs they cause. We reserve the right to charge customers after the service has ended using their original payment method.

  • Personal belongings: We are not liable for any lost, stolen, or forgotten personal items. What you bring on board is your responsibility.

  • Personal safety: Participation is at your own risk. Boatox accepts no liability for injuries, accidents, or health issues. You must follow the captain’s and crew’s instructions at all times.

5. Customer Responsibilities

  • You must respect local laws, the captain’s authority, and the rules of the boat.

  • Excessive alcohol consumption or any illegal drug use is strictly prohibited. Violations may result in immediate termination of the charter without refund.

  • Use of water toys or sports equipment (e.g. jet skis, paddleboards) is entirely at your own risk.

  • Guests with medical conditions (including pregnancy, heart or back problems) participate at their own risk.

  • Minors under 18 are only permitted when accompanied by a responsible adult, who assumes full responsibility for them.

6. Late Arrival & No-Show

  • Please arrive on time.

  • For private charters: Late arrival may reduce your rental time - no refund is given.

  • For yacht sharing: If you arrive more than 15 minutes late, the boat will depart without you. No refund will be provided.

7. Service Changes & Substitutions

  • If a third-party provider cancels or becomes unavailable, Boatox may provide an alternative of equal or greater value.

  • If weather conditions or force majeure (storms, strong winds, strikes, natural disasters, government restrictions) prevent safe operation, Boatox or the provider may cancel. In such cases, our Refund Policy applies.

8. Force Majeure

Boatox is not liable for any failure or delay caused by events outside our control, including weather, strikes, technical issues, or government restrictions.

9. Content & Media Rights

By joining our experiences, you agree that Boatox may use photos, videos, or other media taken during the service (including social media content) for promotional purposes, without further consent or compensation.

10. Data Sharing

To deliver services, Boatox may share your booking details (name, contact info, special requests) with third-party providers such as yacht operators, clubs, or restaurants. See our Privacy Policy for details.

11. Liability Limitation

To the maximum extent permitted by law:

  • Boatox is not liable for delays, cancellations, accidents, injuries, property damage, or lost enjoyment.

  • We are not responsible for the condition, safety, or performance of third-party services.

  • In no case shall Boatox’s liability exceed the total amount paid for the booking.

12. Changes to Terms

We may update these Terms at any time before a booking is confirmed. Any changes will be communicated via the same channel used for booking (email or WhatsApp).

13. Governing Law & Jurisdiction

These Terms are governed by German law. Place of jurisdiction is Hamburg, Germany. The place of performance for services is Ibiza, Spain.
In case of discrepancies between language versions, the English version shall prevail.
